OFFICIAL RULES
NO PURCHASE NECESSARY.
ONLY OPEN TO RESIDENTS IN CANADA, FRANCE, UNITED KINGDOM, GERMANY AND THE UNITED STATES. VOID IN QUEBEC, NORTHERN IRELAND, GUAM, PUERTO RICO, AND ALL OTHER U.S.
TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED BY LAW.
Eligibility: FIRST CONTACT DAY 2026 CONTEST (“Contest”) is open to citizens who reside in one of the following geographic areas: Canada (excluding Quebec), France, Germany, United Kingdom (“U.K.”) (including England, Scotland, Wales and excluding Northern Ireland), and the United States (“U.S.”) including the District of Columbia (“D.C.”) (excluding Guam, Puerto Rico, and all other U.S. territories and possessions) (collectively “Geographic Area(s)”). Individuals who do not reside in one of these Geographic Areas are prohibited from entering the Contest. Entrants must be eighteen (18) years of age or have reached the age of majority (i.e. legally recognized as an adult) in the jurisdiction where he/she resides. Entrants must also have a valid Social Security number, a valid U.S. Individual Taxpayer Identification Number, Social Insurance Number and/or a valid taxpayer reference number issued from his/her country of residence. Employees of Scopely, Inc. (“Sponsor”), Blue Raven LA, Enteractive Solutions Group, Inc. (“Contest Administrator”), advertising or promotion agencies, those involved in the production, development, implementation or handling of the Contest, and any agents acting for the above entities, and their respective parent companies, officers, directors, subsidiaries, affiliates, service providers, prize suppliers, assigns, or any other person or entity associated with Contest (collectively “Contest Entities”) are not eligible to enter the Contest. Immediate family members (i.e. a spouse, domestic partner, child, sibling, or parent) and/or any person, whether related or not, living in the same household of an individual affiliated with a Contest Entity are also ineligible to enter the Contest.
How to Earn Points: Entrants can earn First Contact Relics based on four (4) criteria: i) completing Events, ii) achieving in-game progression Metric/Efforts, iii) performance relative to other Entrants, and iv) completing at least ten (10) of the twelve (12) Events. By completing an Event, Entrants will receive a First Contact Voucher that will award between zero (0) and eight thousand one hundred ten (8,110) First Contact Relics, based on the above mentioned criteria. Entrant may participate in any or all Events. Winners will be determined by the highest number of First Contact Relics at the conclusion of the Contest.
The Game may not be accessible from all mobile phones, handheld devices, and/or tablets. If entrants use a web-enabled mobile device to participate, data rates may apply (entrants should contact their service provider for data rates/plans). Entrants should use care and not drive or operate machinery while entering the Contest.
• Twenty (20) Silver Tier Prizes: Starfleet Borg Encryption Tactical Access Key (damaged) recovered from the alternate timeline, and a limited-edition Star Fleet Command commemorative shirt. $70 Silver Tier Prize ARV.
• Twenty (20) Bronze Tier Prizes: A limited-edition Star Fleet Command commemorative shirt. $20 Bronze Tier Prize ARV.
The total ARV of all prizes is $3,880 USD. The ARV for winners outside the U.S. is the equivalent amount based on the exchange rate at the time the prize is awarded. No prizes will be awarded to a group or organization. Limit one (1) prize per person/family/household for the entire Contest Period. Any expenses associated with the receipt or use of a prize not specifically mentioned as being included (e.g., any applicable custom fees) are excluded and are the responsibility of each winner(s). No cash equivalent for prize(s) will be available. Prize(s) is not transferable. However, Sponsor may, in its sole discretion choose to substitute a prize (or prize component) of equal or greater value due to unavailability or for any other reason. Sponsor reserves the right, in its sole discretion, to replace any merchandise with a newer model or version of same; but, in such event, Sponsor will continue to use the value of the “old” (i.e. replaced) item for purposes of calculating the ARV. As applicable, the prize(s) will only be mailed/shipped/electronically delivered to persons residing in the Geographical Areas. Any depiction of prize(s) in promotional materials or otherwise is for illustrative purposes only.
Notification: The potential winners will be notified via in-game notification and/or account email within one (1) week after the Contest has ended. The notification will include a link to a secure eligibility form which must be completed by each potential winner within seventy-two (72) hours from the date the notification was sent (“Eligibility Form”). The information required on the Eligibility Form includes: first and last name, mailing address including country, email address, and month/year of birth. Failure to complete the Eligibility Form within seventy-two (72) hours of it being sent will result in disqualification and the prize will be forfeited. If a potential winner(s) does not complete the Eligibility Form within seventy-two (72) hours; is found to be ineligible; if he/she does not comply with these Official Rules; or if any electronic communication is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner who received the next highest score on the Leaderboard may be declared a potential winner in Sponsor’s sole discretion. If a potential winner is deemed a minor in his/her jurisdiction, his/her parent or legal/guardian must complete the notification process on his/her behalf.
Prize Claim Documents: Depending upon the prize, potential winner(s) may be required to electronically sign and return an unmodified Affidavit of Eligibility, a Liability Release (where legal), and a Publicity Release (collectively “Affidavit/Release”); a copy of his/her legible government issued photo identification; and provide any other documentation that Sponsor requires (e.g. background check if an experiential prize is awarded in Sponsor’s sole discretion) (collectively “Prize Claim Documents”) within five (5) days of receipt by potential winner(s). The potential winner then and only then becomes the “winner.” If a potential winner does not provide the applicable Prize Claim Documents required herein, as determined in Sponsor’s sole discretion, said person(s) may be disqualified, the prize will be forfeited, and Sponsor will have no further obligation to such potential winner. Electronic documents have the same force and effect as originals. By completing the Prize Claim Documents, each winner attests to the provisions stated therein including the accuracy of the information contained therein and compliance with these Official Rules. If a potential winner cannot be reached, is found to be ineligible, does not complete the applicable Prize Claim Documents in the time frame listed above, and/or if he/she does not comply with these Official Rules, said potential winner will be disqualified. If potential winner(s) is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal guardian will be required to sign the Prize Claim Documents on his/her behalf and the prize will be awarded in the name of said parent/legal guardian.
Tax Obligations: All federal, state, and/or other applicable taxes (including but not limited to income taxes for a U.S. winner) arising from participation in the Contest or the award of a prize may be required by applicable tax authorities in the jurisdiction in which a winner resides and is the sole responsibility of each winner. Non-U.S. prize winners may be subject to 30% withholding taxes which must be collected prior to receiving any prizes. U.S. winners will be issued an IRS Form 1099-MISC or equivalent tax reporting documents for prizes valued at $2,000 or more, and non-U.S. winners will be issued an IRS FORM 1042 or equivalent tax reporting documents as required by United States law, from the Sponsor for the total ARV of the prize won (as stated herein) in the calendar year won.
Personal Data/Privacy Policy: Entrants understand and agree that personal data/information they provide will be processed in the U.S. (i.e. outside the EEA and/or not in the country or jurisdiction of any other eligible country). Your data will be processed by Scopely, Inc., its affiliated companies, and its vendor Blue Raven for the purpose of administering this contest Each entrant’s personal data will be used for purposes of administering the Contest including not limited to any required applicable record keeping, tax forms, state registrations, and/or any prize fulfillment obligations. The Contest Entities does not and will not sell the personally identifiable information of any entrant or winner. Furthermore, the Contest Entities will not share or disclose any personally identifiable information to any third-party company or business unrelated to the Contest. Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of their parent/legal guardian. To the maximum extent permitted by law, any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor’s Privacy Policy located at https://www.scopely.com/en/legal?id=privacy&langSection=en. To the maximum extent permitted by law, except where prohibited by law and Sponsor’s Privacy Policy: (1) entrant’s acceptance of prize constitutes permission for the Contest Entities to use an entrant’s first name, last initial, state/province/region and country for advertising/publicity purposes worldwide and in all forms of media in perpetuity, without further notice to or compensation in connection with said Contest or the prizes awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrants or any third parties.
General Conditions: This Contest is governed by these Official Rules and all applicable federal, state, territorial, provincial, and local laws. By entering the Contest, and to the maximum extent permitted by law, entrants agree and acknowledge to be bound by these Official Rules, as well as the decisions of the Sponsor and the Contest Administrator, which are final and binding in all respects; to waive any rights to claim ambiguity with the Official Rules; and to indemnify and hold harmless the Contest Entities from any and all liability resulting or arising from the Contest or the use of any submitted Entry; and to release all rights to bring any claim, action, or proceeding against the Contest Entities. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Contest, to be acting in violation of the Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person. Any person attempting to defraud or tamper with the Contest may be prosecuted and is not eligible for a prize. If, for any reason, the Contest is not capable of running as originally planned, the Sponsor, in its sole and absolute discretion, reserves the right to cancel, suspend, and/or modify the Contest or any portion thereof and to assess the scoring and award the prize(s) from all salvageable eligible Entries received prior to and/or after (as appropriate) the action taken by the Sponsor, or award the prize(s) in a manner that is fair and equitable as determined in Sponsor’s discretion. In case of a dispute over the identity of an entrant who submitted a winning Entry, the authorized account holder of the Account on the Platform affiliated with that Entry will be deemed the entrant. Said person must comply with these Official Rules, be the person who completed the act of entering, and, in the Sponsor’s sole and absolute discretion, may be required to provide proof of ownership of the Account on the applicable Platform.
Disclaimers: The Contest Entities are not responsible or liable for Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), in excess of the stated limit, or for Entries that are illegible, late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, misplaced, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, or otherwise not in compliance with these Official Rules. Any such Entries will be disqualified. By entering the Contest, the entrants agree and acknowledge that the Contest Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury, or death) in connection with: participation in this Contest; human error; incorrect or inaccurate transcription of Game account information; acceptance/possession, use/misuse, and/or defects of a prize (or prize element) awarded herein; typographical errors in the promotional material; fraudulent (including unauthorized) gift cards/ certificates/vouchers made with lost, stolen, misplaced, misappropriated or incomplete (including inaccurate) database information and/or canceled gift cards/certificates/vouchers; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; any interruption or inability to access the Game (or Sponsor’s/Contest Administrator’s inability to access the Game), or any website or online service via the internet due to hardware or software compatibility problems; wireless network dead zones or obstructions; any damage to an entrant’s (or any third person’s) computer/mobile device and/or its contents related to or resulting from any part of this Contest or from entering or downloading materials/software in connection with the Contest; and/or any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions; even if caused by the negligence of one of the Contest Entities. Entrants hereby acknowledge that said Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including any applicable express warranties provided exclusively by a prize supplier that may be sent along with a prize. To the maximum extent permitted by law, the Contest Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused by or have contributed to (1) any wrongful, negligent or unauthorized act or omission on the part of a prize supplier or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (3) any other cause, condition, or event whatsoever beyond the control of the Sponsor or its parents, subsidiaries, and affiliated companies. The failure of the Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, demonstrations, riot, earthquake, terrorism, act of public enemies, strikes, epidemics, pandemics, actions of governmental authorities outside of the control of the Sponsor (excepting compliance with applicable codes and regulations), or other force majeure event will not be considered a breach of these Official Rules. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Contest materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.
Governing Law, Jurisdiction, Arbitration: All entrants acknowledge and understand that they are entering into a Contest being run and administered in the U.S. and acknowledge that the Contest is subject to the laws and exclusive jurisdiction of the U.S. State of California to the maximum extent permitted by law. To the maximum extent permitted by applicable law, any controversy or claim arising out of or relating to (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the state of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. To the maximum extent permitted by law, any controversy or claim arising out of or relating to these Official Rules, its enforcement, arbitrability or interpretation shall be submitted to final and binding arbitration, to be held in Los Angeles County, California, before a single arbitrator, in accordance with California Code of Civil Procedure §§ 1280 et seq. The arbitrator shall be selected by mutual agreement of Sponsor(s) and the entrant or entrants bringing forth the controversy or claim, which to the extent permissible must be brought individually and not as part of a class/group (collectively, the “Parties”) or, if the Parties cannot agree, then by striking from a list of arbitrators supplied by the American Arbitration Association or JAMS/Endispute. The arbitration shall be a confidential proceeding, closed to the general public. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator’s award is based. The Parties will share equally in payment of the arbitrator’s fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert, and attorneys’ fees and other expenses to the same extent as if the matter were being heard in court). To the maximum extent permitted by law, entrant(s) agrees that his/her claim will be resolved individually, exclusively by arbitration (where legal), without resort to any form of class action. To the maximum extent permitted by law, each entrant(s) further agrees that any claim/judgment/award in such arbitration shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Contest and in no event will entrant(s) be permitted to obtain attorneys’ fees, other legal costs and/or be entitled to awards. To the maximum extent permitted by law, entrant(s) hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. Should any term of this section be deemed by a tribunal of competent jurisdiction void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring this section within the requirements of law, be deemed to be severed from the other terms of these Official Rules, and the remainder of these Official Rules shall be given effect as if it had not included the severed term herein. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
